SBA Appeals Federal Court Ruling

The U.S. Small Business Administration (SBA) is appealing a United States District Court ruling filed against them by the American Small Business League (ASBL) under the Freedom of Information Act (FOIA). The SBA, an agency responsible for every aspect of federal small business contracting programs and policy, is directed to release the specific names of all recipients of federal small business contracts during the fiscal years 2005 and 2006, following a court hearing on August 25, 2008.
According to the ASBL, the decision to appeal is the latest in a series of moves by the Bush Administration to limit the public’s access to information regarding federal small business contracting programs. The information was requested to prove that during the Bush Administration, most small business contracts were actually rewarded to Fortune 500 firms.
During the August court hearing, the SBA attempted to convince the court that they do not possess any of the requested information, stating that it was “not an agency record.” Despite SBA lawyer’s efforts, the court ruled in favor of ASBL.
The case will now move to the 9th Circuit Court of Appeals.
